The script is a summary of civil society’s position on the moratorium in Indonesia. There are two main missions of this script. Firstly, it is an effort to provide comments on the Presidential Instruction on Moratorium (Presidential Instruction No 10/2011) and to push for a change in the Presidential Instruction with a new, higher policy. Secondly, it aims to position this as points of view for changes in the overall forestry legal system in Indonesia, especially for aspects of the moratorium that have not been addressed by other advocacy groups.
Civil Society’s Position on the Moratorium:
– The moratorium is not the final goal but a process that must be passed through to achieve a reduction in the deforestation rate.
– The moratorium is not time-bound but is determined by meeting basic prerequisites measured through criteria and indicators of sustainable forest management, including environmental and social safeguards.
– The moratorium is not limited to new permits but also includes a review of existing permits and a halt to logging using old permits.
– The moratorium ensures total protection of remaining forests (primary and natural forest ecosystems) and peat swamp ecosystems.
– The moratorium provides space for the recognition of community rights.
Criteria and Success Indicators:
– The moratorium period is an opportunity to reorganize forest governance policies and develop policies to resolve forestry conflicts and inequities.
– References for changes include TAP IX/MPR/2001 and the environmental management principles stated in Law No 32/2009.
– No conversion in natural forest areas, forest ecosystem units, and remaining peat/swamp lands for industrial purposes.
– No overlapping of areas in spatial planning.
– Guarantee of rights of access and control for indigenous/local communities in forest areas.
– Review of all permits in forest areas and no more permits above important ecological areas, conservation areas, and areas with high carbon values.
– Restoration of protective areas.
– Issuance of restoration permits and conservation plans must be based on the principle of Free Prior Informed Consent (FPIC) by the community.
